Will put an end to football’s transition market – VG

FIFPro, the professional football players’ union, submit a complaint to the European Commission requesting that the football transfer fees must be removed.

FIFPro is a association for 58 national unions and has about 65,000 members. The organization claims in its appeal that the football transfer system is not working in accordance with the purpose.

– FIFPro has brought a case against FIFA to challenge the worldwide transition system, which we believe prevents competition and illegal, said Secretary General Theo van Seggelen at a news conference Friday.

The organization wants an end to the players bought and sold between clubs for huge sums, but FIFPro says it is too early to speculate on how player transfers will take place in the future if the current system to be illegal.

The organization still look for a world without spillerlån and without transition windows. FIFPro also want to set a limit on how much affiliates can make a charge, limiting the size of the player stables and requires that clubs must pay wages on time.

– We are deeply concerned for transition bubble created in the football market. We are afraid it will crack – and soon, says FIFPro president Philippe Piat.

The complaint claims that the transitional system, which in its current form has existed since 2001, a contrary to EU rules on free competition.

It argued further that the current system has led to a situation where the market is dominated by a few wealthy clubs, and that the gap between them and the rest steadily increases .

Furthermore, it is claimed that the system has not led to stable contract conditions for the players, and that it has led to side effects such as third-party ownership and buying and selling of minors.

The appeal is directed against FIFA , which administers the international transitional through its regulations for player status and transitions (RSTP).

Failed

FIFPro said in 2013 that the organization intended to challenge the transitional system of legality.

– Transition system fails 99 percent of the players, it fails football as an industry and it fails world’s most beloved sport, said Piat then.

According to FIFPro treated FIFA annually about 4,000 disputes between players and clubs, many regarding unpaid wages. The union says that players first 90 days without pay is entitled to demand the contract rescinded and that the dispute then lasts throughout the 590 days on average.

On the other side says FIFPro that a player who violates the terms of the contract being excluded for four months and must pay compensation based on market value. It can correspond to several years’ salary.



Requesting negotiations

The European Club Association (ECA), an organization for the clubs with more than 200 members, asked recently FIFPro to sit at the negotiating table rather than file a complaint to the European Commission.

– We have been in talks with FIFPro, and I hope we can find solutions acceptable to both parties, said ECA Chairman Karl-Heinz Rummenigge.

– It may not be good for football to find solutions through legal processes.
